2. Adoption and Foster Program Terms

The Rigorous Process: Commitment, Screening, and Ethical Standards in Pet Placement

Participation in the FURPA Adoption and Foster Programs is governed by specific, mandatory criteria and is entirely at the discretion of the FURPA Adoption Director, Sarah Jenkins.

2.1 Application and Vetting

Submission of an adoption or foster application through our systems (managed via info@furpa.site) is an offer to adopt/foster and does not constitute a contract or a guaranteed placement. All applicants are subject to a mandatory, multi-step vetting process which includes:

  • Verification of Identity and Residence: Applicants must provide verifiable government-issued identification and proof of current address.
  • Home/Safety Checks: Applicants must agree to, and successfully pass, a virtual or in-person home visit/check conducted by a FURPA representative to ensure the environment is safe, secure, and appropriate for the specific needs of the animal being considered.
  • Reference Checks: Applicants must provide contact information for current or previous veterinary services, as well as personal references. Applicants authorize FURPA to contact these parties directly.
  • Transparency and Honesty: Applicants warrant that all information provided in the application and subsequent interviews is truthful, accurate, and complete. Any misrepresentation or omission of material facts, particularly regarding pet ownership history, housing status, or household members, shall be grounds for immediate and permanent disqualification from the program.

2.2 Right of Refusal and Final Authority

FURPA reserves the absolute right, without providing specific reason or justification, to reject any adoption or foster application at any stage of the process. Our decisions are guided by what we determine to be the best interests and welfare of the animal, based on the assessment of our veterinary and behavioral specialists (Dr. Helena Vance and Marcus Chen) and the Adoption Director (Sarah Jenkins). Final approval rests solely with FURPA. The adoption agreement, executed upon final placement, is a separate legal contract that supersedes this section and contains detailed clauses regarding return policy, care standards, and mandatory follow-up requirements.

2.3 Mandatory Spay/Neuter and Microchipping

All pets adopted from FURPA are, by policy and legal mandate, spayed or neutered prior to adoption. 3. Financial Transactions and Donations

3.1 Donation Terms

  • Non-Refundable: All donations made to FURPA are non-refundable. As a non-profit organization, funds are immediately allocated to animal care, medical expenses, and operational costs. We are unable to issue refunds once a donation is processed.
  • Use of Funds: Donors understand that their contribution will be used to further the general mission and objectives of FURPA, including but not limited to, veterinary care, food, facility maintenance, and behavioral rehabilitation programs. While we strive to honor requests for restricted donations (e.g., to a specific medical fund), FURPA retains the final authority and discretion to re-designate any restricted funds to the area of greatest organizational need, particularly in emergency situations, to ensure the sustainability of our lifesaving work.
  • Tax Deductibility: FURPA is a non-profit organization. Donors are responsible for consulting with their tax professional regarding the deductibility of their contributions.
  • Processing Security: Donations are processed via a third-party secure payment gateway. By submitting a donation, you agree to abide by the terms and privacy policy of that payment processor. FURPA does not store your full credit card information.

3.2 Fees and Charges

The User is solely responsible for any transaction fees, foreign exchange charges, or bank charges associated with their donation or payment. Should an electronic transaction be rejected or returned due to insufficient funds, the User agrees to pay any applicable returned payment fees imposed by FURPA and/or our financial institution.

4. Volunteer and Outreach Terms

Partnership in Action: Guidelines for Community Involvement and Conduct

Volunteers are essential to our mission, and their involvement is subject to specific terms ensuring safety, professionalism, and ethical animal handling.

4.1 Enrollment and Conduct

  • Waiver and Release: All prospective volunteers must complete and sign a separate, comprehensive Volunteer Agreement and Waiver of Liability before commencing any service, acknowledging the inherent risks associated with handling animals, particularly rescued pets with unknown histories.
  • Training and Compliance: Volunteers must complete all mandatory training modules provided by the Volunteer Coordinator (Ricardo Morales) and adhere strictly to all safety protocols, animal handling procedures, and low-stress environment guidelines, including those established by our behaviorist (Marcus Chen). Failure to comply with safety and handling protocols is grounds for immediate termination of volunteer status.
  • Confidentiality: Volunteers may be exposed to confidential information regarding an animal’s medical history, behavioral assessments, or adopter background checks. Volunteers agree to maintain the strict confidentiality of all such information and not to disclose it to any external parties, including other volunteers or the public.
  • No Personal Gain: Volunteer service is unpaid. Volunteers agree not to use their status with FURPA to solicit personal donations, sell goods or services, or engage in any activity that conflicts with the non-profit mission of the organization.

4.2 Termination of Volunteer Status

FURPA reserves the right to terminate a volunteer’s service immediately and without prior notice for any reason, including but not limited to: violation of safety protocols, breach of confidentiality, conduct detrimental to the welfare of the animals or the organization, or failure to meet commitment requirements. The decision of the Volunteer Coordinator is final.

5. Disclaimers and Limitation of Liability

Legal Protections: A Statement on Risk, Warranty, and Organizational Responsibility

FURPA provides its services and information on an “as-is” and “as-available” basis without warranties of any kind.

5.1 Animal Condition Disclaimer

  • No Warranty of Health: While our Chief Veterinary Officer (Dr. Helena Vance) ensures that every animal is examined, vaccinated, spayed/neutered, and treated for all known conditions prior to adoption, FURPA makes no warranty or representation, express or implied, regarding the present or future health, temperament, or behavioral status of any adopted animal. Animals, particularly those rescued from neglect, may carry latent diseases, or develop behavioral issues not identifiable during the evaluation period.
  • Assumption of Risk: Adopters and Fosters acknowledge and agree that they are accepting the animal with all potential risks, including the potential for injury to persons or property, or the development of unexpected health or behavioral problems. The Adopter/Foster assumes full responsibility for the animal from the moment of transfer.

5.2 Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall FURPA, its directors, employees, volunteers, or agents be liable to any user or third party for any direct, indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, or goodwill, arising out of or related to:

  • The User’s access to or use of the website or services.
  • Any animal adopted, fostered, or encountered through FURPA’s programs.
  • Any personal injury or property damage resulting from an animal adopted or handled through FURPA.
  • Any errors or omissions in the content of the website or the applications.

The maximum cumulative liability of FURPA for any and all claims related to these Terms or the services provided shall not exceed the lesser of the amount paid by the User to FURPA in the preceding twelve (12) months or one hundred U.S. dollars ($100).

6. Indemnification

You agree to defend, indemnify, and hold harmless FURPA, its affiliates, directors, officers, employees, and volunteers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your violation of these Terms and Conditions.
  • Your use of the website and services, including any use of the website’s content, services, and products other than as expressly authorized in these Terms.
  • Your handling, ownership, or custody of any animal adopted or fostered through FURPA.
  • Any negligent or willful misconduct by you or any third party under your direction during volunteer service or other interaction with FURPA.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or related to these Terms, the Privacy Policy, or the relationship between the User and FURPA shall be instituted exclusively in the federal or state courts located in Orange County, California. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. Prior to initiating any legal action, both parties agree to first attempt to resolve the dispute informally for a period of no less than sixty (60) days, by submitting written notice of the dispute via email to info@furpa.site with the subject line [ADMIN] Formal Dispute Notice.

8. General Provisions

Miscellaneous Clauses: Final Legal Commitments

  • Entire Agreement: These Terms and Conditions, together with our Privacy Policy and any executed Adoption or Volunteer Agreement, constitute the sole and entire agreement between you and FURPA regarding the website and services, superseding all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
  • Waiver: No waiver by FURPA of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of FURPA to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability: If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
